1. Acceptance of Terms
By downloading, installing, or using symbiont vs ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
2. Description of Service
symbiont vs is a macOS application designed to control and manage the KORG volca sample 2 hardware synthesizer via MIDI. The App provides features including sample management, sequence editing, motion sequence drawing, live performance control, and MIDI monitoring.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or commercial music production purposes. This license is governed by the Apple Standard End User License Agreement (EULA).
4. In-App Purchases
The App offers a free tier with basic functionality and an optional one-time In-App Purchase ("Pro Unlock") that unlocks additional features. All purchases are processed by Apple through the App Store. Pricing is displayed before purchase. Fees paid are not refundable, except as required by applicable law.
5. Hardware Requirements
Certain features of the App require a KORG volca sample 2 connected via USB-MIDI. The App is designed to work with this specific hardware device. We do not guarantee compatibility with other MIDI devices or future hardware revisions.
6. Intellectual Property
The App, including its design, code, graphics, and documentation, is the intellectual property of the developer. "Korg" and "Volca Sample" are trademarks of KORG INC. symbiont vs is an independent product and is not affiliated with, endorsed by, or sponsored by KORG INC.
7. User Content
You retain ownership of all content you create using the App, including sequence data, sample configurations, and project files. The App stores your content locally on your device and does not upload it to any server.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Use of the App with your hardware device is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, damage to hardware, or interruption of creative workflow.
10. Data Handling
The App does not collect, store, or transmit any personal data. For details, please refer to our Privacy Policy.
11. Updates and Modifications
We may update the App from time to time to improve functionality, fix bugs, or address compatibility issues. We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
12. Termination
We reserve the right to terminate or suspend your access to the App if you violate these Terms. Upon termination, the license granted to you will immediately cease.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
